1. Who we are
Rapid Store is provided by Bainbridge Services (company number I25008115), 30 Calodyne Bungalows, St Francois, Mauritius 31726 (“we”, “us”). By creating an account or subscribing, you agree to these terms. If you use Rapid Store for a business, you confirm that you may bind it to them.
2. The service
Rapid Store lets you open your own online shop: products, bookings, courses, event tickets and hire, on an address under rapidstore.net or your own domain. Each shop runs in its own isolated environment with its own database and file storage. You can also connect an AI assistant to your shop; that is optional, you choose what it may do, and you can withdraw it at any time.
3. Your account
Give us accurate details and keep your sign-in secure. You are responsible for what happens under your account, including the actions of staff you invite. Tell us promptly if you think your account has been misused.
4. The free trial
Every new shop starts with a 30-day free trial with every feature switched on. We do not ask for a card to start it. We will not charge you unless you choose to subscribe.
5. Price, billing and renewal
After the trial, keeping your shop open requires a subscription:
- Rapid Store: £10 per month
Prices are in pounds sterling and exclude VAT and other sales taxes, which are added at checkout where they apply. A subscription renews automatically every month until you cancel it, and the payment method you gave is charged at the start of each period. We may change a price by giving you at least 30 days’ notice; the new price applies from your next renewal, and you can cancel before then.
6. Cancelling
You can cancel at any time, online, with the Cancel subscription button on your shop’s billing page (it takes you to Paddle’s customer portal). Cancellation takes effect at the end of the period you have already paid for, and nothing further is charged. Our Refund Policy explains refunds.
7. If the trial ends or a payment fails
If you have not subscribed when the trial ends, your shop is paused for shoppers and you can still sign in. After a further 7 days it goes offline completely. Subscribe at any point and it is back within seconds, with its products, pages and settings intact. If nothing happens for 30 days after that, we email you an export of everything and then delete the shop. The same applies to a subscription that ends or whose payment keeps failing.
8. Your content and your customers’ data
Your shop’s content and your customers’ data are yours. You give us the permission we need to host, store, back up and display them in order to run your shop. You can export everything at any time. Where your shop handles personal data about your own customers, you decide why and how, and we act on your instructions as your processor (see our Privacy Policy).
9. Selling through your shop
Your sales are between you and your customers. We are not a party to them. You are responsible for what you sell, your prices, your delivery, your own refunds, your taxes and the policies you publish. Payments you take in your shop go through the payment providers you connect (for example PayPal or Peach Payments) under your own agreement with them.
10. Acceptable use
Do not use Rapid Store to sell anything unlawful, to infringe anyone’s rights, to send spam, to spread malware, to attack or overload any system, or to get around the limits of your plan. We may suspend or remove content or a shop that breaks these rules, and will tell you why when we can.
11. Availability and changes
We take reasonable care to keep the service running, and we back every shop up each night, with a copy kept off-site. How often your shop is available is set out in section 12. Beyond that commitment, we do not promise that the service will be uninterrupted or error-free, and you should keep your own exports of anything you cannot afford to lose. We may improve or change features; if we remove something you rely on, we will tell you in advance where we reasonably can.
12. Uptime commitment
What we commit to. In each calendar month, your shop will be available to visitors at least 99% of the time (the “Commitment”).
How it is measured. Every minute we check that your shop answers at its platform address, through the same route a visitor uses. A minute in which no check succeeded is a minute the shop was down. A month’s uptime is the share of the minutes in which your shop was meant to be open (while your subscription or free trial was active) that it answered, rounded down to the hundredth of a percent.
What is not counted. Minutes while the shop was paused because its free trial ended without a subscription, while it was suspended, or after it was deleted. Minutes while the shop was in maintenance because you started a restore from a backup, or while we move your shop to another server or rename it internally. Minutes while we are releasing an update to the platform or to your shop, which we record as it happens. Minutes before we first checked your shop. Problems caused by things outside our control, such as your own domain’s DNS settings, your payment provider, or the content and configuration you have chosen. Any other time your shop does not answer is counted, including when one of our servers is off or restarting outside an update.
How credit works. If a month falls short of the Commitment and you were on a paid subscription for it, we credit part of that month’s subscription payment to your account: 10% if uptime was below 99%, 25% if below 95%, and 50% if below 90%. The credit is sent to Paddle against that month’s payment and, as Paddle describes it, is held on your account against your next bill. Shops on a free trial, shops we have given a plan free of charge, and shops whose subscription is cancelled, or set to cancel, when the month closes, do not receive a credit, but do receive the monthly figures.
Your monthly record. At the start of each month we send the owners and co-owners of each shop its record for the month before: its uptime, its outages, its response times and any credit. The Service record screen in your shop shows the last twelve months.
Credit is your remedy. The service credit described above is our only liability for missing the Commitment, except where the law gives you rights that cannot be limited. Nothing in these terms limits liability for fraud or gross negligence, and section 13 applies to everything else.
13. Our responsibility to you
Nothing in these terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, for fraud or gross negligence, or your rights as a consumer. Subject to that, we are not liable for indirect or consequential loss, or for lost profits, revenue or data, and our total liability for anything arising from the service is limited to the fees you paid us in the 12 months before the claim.
13. Ending
You can stop using Rapid Store at any time. We may suspend or end your access if you materially break these terms and do not put it right after we ask you to, or immediately where the breach is serious or the law requires it.
14. Changes to these terms
We may update these terms. For a material change we will tell you by email or in your account before it applies. Continuing to use the service afterwards means you accept the new terms.
15. Governing law
These terms are governed by the law of Mauritius. If you are a consumer, you keep the mandatory consumer protections of the country where you live.
16. Payments and Paddle
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders, handles payment, invoicing, sales tax and refunds, and provides customer service for payment enquiries. Paddle’s Buyer Terms apply to your purchase, alongside these terms. The service itself is provided to you by us.
